In a rear-end collision on the same route of travel, the defendant’s vehicle collided with the plaintiff’s car. The first plaintiff suffered numerous severe injuries, including herniated discs at C5-C6, bulging discs at C3-C4, C5-C6, and L4-L5, radiculopathy at C5 and L5, right shoulder impingement, right hip bursitis, and a partial tear of the right hamstring. The second plaintiff sustained bulging spinal discs.
The plaintiffs alleged the defendant was negligent, failing to make proper observations, operating their vehicle at an excessive speed, and failing to maintain a proper lookout. The defendant denied liability; however, the jury found in favor of the plaintiffs, awarding a total of $15,000 in damages.
